Licensed Application End User License Agreement (EULA) / Terms of Service

This End User License Agreement ("Agreement" or "EULA") is a binding legal agreement between you (the "User" or "Passenger") and INNER LOOT INNOVATIONS LLC ("Company," "we," "us," or "our").

This Agreement governs your use of the TrainTrax mobile application (the "App" or "Licensed Application") and our website at https://traintrax.innerloot.com (the "Site"). By downloading, installing, registering for, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not download, install, or use the App.

1. Acknowledgement

You and the Company acknowledge that this Agreement is concluded between you and the Company only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). The Company, and not Apple or Google, is solely responsible for the App and the content thereof.

2. Minimum Age & Eligibility

To use TrainTrax, you must be at least 18 years of age or older. By registering for an account, you represent and warrant that you meet this age requirement. The App is currently intended for use strictly within the United States.

3. User-Generated Content (UGC) & Social Safety (Guideline 1.2 Compliance)

TrainTrax is built to foster professional networking, collaboration, and community. Because users can post to bulletin boards, upload resources ("Cargo"), and send direct or group messages, we maintain strict safety rules to protect our community.

A. Prohibited Content & Zero-Tolerance Policy

You may not submit, post, upload, or share any User-Generated Content (UGC) that:

Is harassing, abusive, threatening, defamatory, or libelous.
Promotes discrimination, hate speech, violence, or harm against any individual or group.
Contains sexually explicit material, nudity, or pornography.
Is fraudulent, deceptive, spam, or contains unauthorized commercial solicitation.
Infringes upon the intellectual property or privacy rights of any third party.

We enforce a zero-tolerance policy for objectionable content and abusive behavior.

B. Reporting & Moderation

Any user can easily report objectionable content or abusive passengers directly in the App.

Action Plan: Company administrators review all submitted safety reports. We commit to reviewing and acting upon reported violations within twenty-four (24) hours by removing the offending content and/or terminating or suspending the account of the user who posted it.

C. Blocking Abusive Users

You have the right and the in-app tool to block any other user inside the App at any time. Once blocked, you and the blocked user will be mutually filtered from each other's direct messaging, feeds, posts, and Coupler recommendations.

4. Account Termination & Deletion

We reserve the right, in our sole discretion, to terminate or restrict your access to your TrainTrax account, without notice, if you violate any terms of this Agreement.

You may request the permanent deletion of your account at any time through the settings of the App or by emailing us at . Once processed, account deletion is irreversible.

5. Intellectual Property Rights

Unless otherwise indicated, the App and the Site are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the App and the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us, or licensed to us, and are protected by trademark and copyright laws.

The "digital railroad," "Boarding Pass," "Coupler," "Manifest," "Cargo," "Lines," and "Stations" layout, design concepts, and thematic terminology are the exclusive intellectual property of INNER LOOT INNOVATIONS LLC. Except as expressly provided in this Agreement, no part of the App, Site, Content, or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

6. Scope of License

The Company grants you a limited, non-exclusive, non-transferable, revocable license to use the TrainTrax App on any Apple-branded or Android-compatible mobile device that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions and Google Play Terms of Service.

7. Maintenance, Support, and Warranties

Support:

The Company is solely responsible for providing any maintenance and support services for the App. You acknowledge that Apple and Google have no obligation whatsoever to furnish any maintenance or support services with respect to the App.

Warranties & Disclaimer:

The App is provided on an "as-is" and "as-available" basis without warranties of any kind. In the event of any failure of the App to conform to any applicable warranty under law, you may notify Apple or Google, and they may refund the purchase price (if any); to the maximum extent permitted by applicable law, neither Apple nor Google will have any other warranty obligation whatsoever.

8. Legal Compliance

You represent and warrant that:

You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country.
You are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third-Party Beneficiary

You and the Company acknowledge and agree that Apple, Google, and their respective subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of this Agreement, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
